SAT & Co. Advocates and Legal Consultants has achieved a remarkable and unprecedented legal victory, securing a final and binding judgment from the UAE Court of Cassation dismissing a counterclaim of extraordinary magnitude valued at more than 9,265 kilograms of pure gold, equivalent to approximately AED 4.5 billion.
The counterclaim sought either the delivery of vast quantities of pure gold or payment of their alleged monetary equivalent. It was primarily based on assertions of market volatility and purported trade customs within the precious metals sector. However, the claim lacked any written contracts, binding pricing mechanisms, or contemporaneous accounting records capable of substantiating an obligation of such exceptional scale.
Across all stages of litigation, the courts consistently reaffirmed a fundamental principle of commercial law: the magnitude of a claim cannot substitute for legal proof. The courts further held that alleged commercial practices, particularly in volatile markets such as precious metals, do not, in themselves, give rise to enforceable rights without clear contractual or documentary evidence.
In its final ruling, the Court of Cassation confirmed that the lower courts had correctly exercised their judicial discretion in assessing the evidence and expert reports. The Court concluded that the counterclaim, despite its extraordinary financial value, was devoid of the legal and factual foundations required to withstand judicial scrutiny.
